Texas Court of Appeal Allows Prempro Lawsuit to Proceed

The Texas Court of Appeals held that a lawsuit against drug manufacturer Wyeth may proceed. The claim brought by a woman claiming that Wyeth’s hormone replacement drug Prempro caused her breast cancer.

The court found that the claims were not preempted by federal law. The court, relying on a recent United States Supreme Court ruling, rejected Wyeth’s argument that the Food and Drug Administration’s approval of a drug preempts state law “failure to warn” claims.

There are currently nearly 5,000 lawsuits based on injuries from hormone replacement drugs.

Firefighter Sues Doctor After Stealing Pain Medication From Dying Woman

A former Lincoln, Nebraska firefighter was arrested for stealing a dying woman’s pain medication. The firefighter is now suing his doctor claiming that the doctor failed to exercise reasonable and ordinary care in prescribing the drugs.

The firefighter alleges that the doctor prescribed nearly 1,500 pain pills, including oxycodone and hydrocodone, over a period of 17 months. The lawsuit asks for compensation for personal injuries, future medical treatments, and lost wages.

Allegedly, the addition became so severe that the firefighter resorted to entering the home of a cancer patient after responding to a 911 call there and stealing a bottle of hydrocodone.

Attention Users of Prescription Raptiva

The Food and Drug Administration announced a voluntary recall of the psoriasis drug Raptiva (generic form: Efalizumab). Genentech, the drug’s manufacturer, recalled Raptiva because of a link between long-term use and a severe brain infection, which often results in death.

According to the FDA, patients who are taking Raptiva should immediately cease use of the drug and consult a doctor about changing their treatment plans. However, the drug is not scheduled to be taken off the market until June of 2009.

Although only three Raptiva-caused deaths have been confirmed, users should be aware of the symptoms due to the brain infection. These symptoms include: (1) weakness, clumsiness; (2) visual impairments; (3) speech problems, slurring word; and (4) changes in personality. If you are exhibiting any of these symptoms you should consult a doctor for confirmation.
